PODER CONSTITUINTE SUPRANACIONAL: NORMA JURÍDICA UNIVERSAL CONTEMPORÂNEA

O presente artigo encontra-se vinculado ao projeto Direitos Humanos Sociais como ’’Jus Cogens’’ Internacional e tem como objetivo demonstrar as lacunas jurídicas que surgem com a evolução sociológica e a futura criação de leis aplicáveis em âmbito universal para adaptação do indivíduo, ocupando seu papel no estado de direito com eficácia plena, partindo da análise teórica de constituição, seus aspectos e funções,  poder constituinte e o caráter de uma norma jurídica universal e suas possíveis alterações contemporâneas e a premissa dos ‘’Jus Cogens’’ como ponto de partida para essa lei universal.

CONSTITUENT SUPRANATIONAL POWER: LEGAL STANDARD UNIVERSAL CONTEMPORANY

ABSTRACT: The current article is attached to the Social Human Rights as “jus Cogens” International and has as objective to demonstrate the legal gaps which rise with the sociological evolution and future creation of applicable laws in universal scope to individual adaptation occupying its role in the rule of law with full efficiency, based on the theoretical analysis of constitution, its aspects and functions, constituent power and the character of an universal legal norm, its possible contemporary changes and the premise of  “Jus Cogens” as starting point to this universal law.
